GENERAL TERMS AND CONDITIONS OF SALE (CGV)

2. OBJECT
The purpose of these CGV is to define the rights and obligations of the parties in connection with the online sale of educational content. The Company offers:
Masterclasses: Pre-recorded digital courses.
Live Classes: Cohort-based courses conducted live (e.g., via Discord).
3. DESCRIPTIONS OF SERVICES
3.1 Masterclasses Masterclasses are pre-recorded digital content. They may be sold as:
Available Now: Immediate access upon payment.
Pre-sale: The Client purchases the course before its official release date to support production. In this case, the content is not immediately consumable. Access will be unlocked automatically on the official launch date specified on the product page.
3.2 Live Classes Live Classes are scheduled events lasting approximately 6 to 8 weeks.
Access: Takes place on third-party platforms (e.g., Discord).
Ticket Types:
Feedback Ticket: Includes personalized critique from the instructor.
Spectator Ticket: View-only access with no personalized feedback.
Prerequisites: The Client is responsible for checking the required skills or software knowledge listed in the course details before purchasing.
4. PRICING
Prices are indicated in Euros (€) and include all taxes (TTC) applicable in France on the day of the order, unless stated otherwise. The Company reserves the right to modify prices at any time, but products will be invoiced based on the rates in effect at the time of order validation.
5. ORDERS & PAYMENT
Validation: The order is confirmed only after full payment has been received.
Payment Methods: We accept [Credit Card / Stripe / PayPal]. Payments are secured by our payment processor.
Account: The Client may be required to create an account to access the content. The Client is responsible for maintaining the confidentiality of their login credentials.
6. DELIVERY & ACCESS
6.1 Digital Masterclasses
For standard orders: Access is granted immediately via the Client’s account dashboard.
For Pre-sales: Access is granted on the release date. The Company will communicate any changes to the release schedule via email.
6.2 Live Classes
Access instructions (e.g., Discord invite links) will be sent via email prior to the start date defined in the product description.
If a Client misses a live session, replays [are/are not] provided (specify your policy here).
7. RIGHT OF WITHDRAWAL (DROIT DE RÉTRACTATION)
7.1 Waiver for Digital Content (Masterclasses) In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium, if the execution has begun with the consumer's prior express agreement and acknowledgment that they thereby lose their right of withdrawal. By purchasing a Masterclass and accessing the content immediately, you expressly waive your right of withdrawal.
7.2 Pre-sales For Pre-sales, the Client retains the right to request a refund up until the moment the content is released/delivered. Once the content is released and accessed, the waiver in clause 7.1 applies.
7.3 Live Classes Refunding of Live Classes is permitted up to [7] days before the course start date. After the course has commenced, no refunds will be issued.
8. INTELLECTUAL PROPERTY
All content provided (videos, PDFs, resources, feedback) is the exclusive intellectual property of The Company and the respective Artists.
Usage License: The purchase grants a strictly personal, non-exclusive, and non-transferable license.
Prohibitions: Sharing account credentials, downloading (unless explicitly allowed), reselling, or distributing course materials to third parties is strictly prohibited and may result in immediate account termination without refund.
9. CODE OF CONDUCT (LIVE CLASSES)
Live Classes involve community interaction on platforms like Discord. We maintain a zero-tolerance policy for harassment, hate speech, or disruptive behavior. The Company reserves the right to remove any student violating these community standards without refund.
10. LIABILITY
The Company creates courses based on rigorous production standards (6-9 months of work). However, The Company creates an obligation of means (obligation de moyens), not an obligation of results. We do not guarantee specific career outcomes (e.g., getting a job). The Company is not liable for technical issues related to the Client's internet connection, computer hardware, or third-party platforms (e.g., Discord outages).
11. APPLICABLE LAW
These terms are subject to French Law. In the event of a dispute, an amicable solution will be sought before any legal action. If no agreement is reached, the courts of Paris shall have exclusive jurisdiction.
